Legal Notice and Terms of use of the Authentic App

Welcome to the app Authentic.

Before using the Authentic App, we ask you to read and understand its terms and conditions of use. By using the Authenticate mobile app, you agree to be bound by these terms and conditions. If you do not agree with them, please do not use the app.

In accordance with the provisions of article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSI), we inform you that the Authentic application is an application operated by the General Secretariat of Digital Administration, hereinafter SGAD.

The SGAD, responsible for the app, hereinafter RESPONSIBLE, makes this document available to users, with which it intends to comply with the obligations provided in Law 34/2002.

Anyone who accesses this application assumes the role of user, committing themselves to the observance and strict compliance with the provisions set forth herein, as well as any other legal provision that may be applicable.

The SGAD reserves the right to modify any type of information that may appear, always informing you of the obligations to which you would be subject and being necessary, to continue using the application, its acceptance.

By using the application you must accept and comply in full with this Legal Notice and Terms of Use.

In the event that these Terms and Conditions of Use are modified, you will be notified with the necessary acceptance on your part in order to continue using the application.

If you do not agree to any of the terms we recommend that you do not use the application.

Access to the App is free of charge. The SGAD reserves the exclusive right to modify, update, cancel, delete, revise, delete or introduce any other change in all or part of the App, at any time, provided that there is a valid cause or reason to justify it and in compliance with the applicable legislation.

The Authentic Application offers services of Authentication, Single Sign On and authorization, of public employees of the Public Administrations (AA.PP.) and related users, in the access to internal applications of the AA.PP.

The information and data collected in Authenticity will be treated solely for the purpose of offering you a service appropriate to the functionalities of the application.

For this purpose, we use your data to offer you the following services:

• Authentication with a high LOA security level On several devices for users who have an installed electronic certificate on their mobile device.
• Authentication a low LOA security level, for users who use username and password or Cl@ve and do not register an electronic certificate in the mobile application.
  Most of your data is obtained from the electronic certificate or electronic DNI set up on your device.

You must not share your App Access Information with third parties and you are solely responsible for any activity performed on your account.

We assume no responsibility for any failures that occur in the App due to incompatibilities, including minimum storage and memory requirements at all times.

By accepting this Legal Notice, you agree not to use the App for fraudulent purposes and not to carry out any conduct that may damage the image, interests and rights of SGAD or third parties, as well as not to take any action aimed at damaging, invalidating or overloading the App or hindering its normal use and operation.

In case of breach of this Legal Notice and Terms of Use, the SGAD reserves the right to limit, suspend or terminate your access to the App, adopting the necessary technical measures.

Finally, it is reported that the SGAD reserves the right to decide at any time on the continuity of the services it provides through the App.

We take your privacy seriously. Please see our Privacy Policy in the My Profile > General Information > Privacy Policy section for information on how we collect, use and protect your personal data.

The security of your information is important to us. We implement security measures to protect your information. Make sure to implement yours and, to ensure the most complete security possible, do not use Authentic on rooted devices or with unofficial firmare. Keep your device up to date. Don’t share your keys or give untrusted sources access to your information.

The SGAD grants you a free and non-exclusive license to use the App worldwide, in a non-transferable manner and solely for the purpose for which it was created.

For the purposes of this License, “Intellectual and Industrial Property Rights” means all rights recognized by any applicable intellectual and industrial property regulations, including copyright, related rights, database rights, trademarks, patents, utility models, industrial designs, domain names, social profiles, registered, requested or unregistered, and including in any case the power to request the appropriate registrations and inscriptions for the obtaining or protection of these rights.

As a user of the application you acknowledge that the SGAD is the owner of all the Intellectual and Industrial Property Rights on the applications, programs, modules and developments that make up the App, including computer systems, data, listings, schemas, interfaces, reports, manuals and other complementary elements.

The designs, logos, text and/or graphics not belonging to the RESPONSIBLE and that may appear in the app belong to their respective owners, being themselves responsible for any possible controversy that may arise with respect to them.

The RESPONSIBLE acknowledges in favor of its owners the corresponding intellectual and industrial property rights, not implying their mere mention or appearance in the application the existence of any rights or responsibility over them, nor endorsement, sponsorship or recommendation by the same.

To make any kind of observation regarding possible breaches of intellectual or industrial property rights, as well as on any of the contents of the application, you can do so through the email secretaria.sgsdg@digital.gob.es.

You will not be able to reproduce, copy, modify or disseminate the programs, applications, developments and other elements that make up the App without the prior, express and written authorization of the SGAD. In addition, it undertakes not to claim or register, directly or indirectly, any Intellectual and Industrial Property Rights related to the App or the SGAD.

You must also refrain from doing any abusive activity or that may violate any law or regulation in force.

By using the Authentic Mobile App, you agree to comply with all applicable laws and regulations.

Do not use Authenticate in a way that may cause harm to other users or the application itself. Usar Autentica con versiones no oficiales de iOS o Android no está permitido. Using Authentic on rooted terminals is not allowed.

You must use the application at your own risk, SGAD is not responsible for direct, indirect, incidental, consequential or other types of losses that may arise from the use of the application.

Since the App is free, you agree that there will be no room for compensation by the SGAD for any damage or harm related to the App.

We reserve the right to modify these terms and conditions at any time.

We will notify you of any changes that must be accepted in order to continue using the application.

From the application , you may be redirected to content from third party websites. Given that the RESPONSIBLE cannot always control the contents entered by third parties on their respective websites, it does not assume any type of responsibility with respect to such contents. In any case, it will proceed to the immediate withdrawal of any content that may contravene national or international legislation, morality or public order, proceeding to the immediate withdrawal of the redirection to said website, informing the competent authorities of the content in question.

The RESPONSIBLE is not responsible for the information and content stored, by way of example, but not limited to, in forums, chats, blog generators, comments, social networks or any other means that allows third parties to publish content independently in the RESPONSIBLE’s app.

However, and in compliance with the provisions of articles 11 and 16 of the LSSICE, it is made available to all users, authorities and security forces, collaborating actively in the withdrawal or, where appropriate, blocking of all content that may affect or contravene national or international legislation, the rights of third parties or morality and public order. If you believe that there is any content in the application that could be susceptible to this classification, please notify the RESPONSIBLE immediately.

The app has been reviewed and tested to work properly. In principle, the correct operation can be guaranteed 365 days a year, 24 hours a day. However, the RESPONSIBLE does not rule out the possibility that there are certain programming errors, or that force majeure, natural disasters, strikes or similar circumstances occur that make access to the application impossible.

In the event that any clause of the License is null, invalid or has no effect between the parties for any reason, the other clauses will remain valid and enforceable, unless the benefits or benefits subject to the null, invalid or ineffective clause have been determinant for the offer or acceptance of the License. In such a case, if such benefits or counter-benefits are essential for one or both parties to enter into the Licence, the Licence shall have no effect.

The License is subject to Spanish legislation.

The parties agree that any dispute, discrepancy, question or claim resulting from the execution or interpretation of the License or related to it, directly or indirectly, will be definitively resolved before the jurisdiction of the Courts and Tribunals of Madrid.
